Waxahachie man, 36, sentenced to 8 years for sexual assault of 2 children

Waxahachie, TX - A 36-year-old Waxahachie resident was sentenced to eight years in prison after he pleaded guilty to charges related to the sexual assault two children.
Michael Del Guerrero, 36, accepted a plea bargain agreement Feb. 15 in the 40th Judicial District Court. He was sentenced to eight years in prison for aggravated sexual assault of a child, eight years on four counts of possession of child pornography, and 600 days in a state jail facility for improper video recording. The sentences, in this case, are running concurrently.
Ellis County and District Attorney Patrick Wilson stated the agreement was entered into with the consent and knowledge of the victims. He noted they were satisfied with the outcome of the case and did not want to go through the trauma of a trial.
“People charged with these crimes and do these kinds of things to children, in my opinion, deserve as much time as possible. However, you have got to balance the needs and the concerns of the victims in these cases,” Wilson explained. “I think that we struck an appropriate balance between the demands of the community and the needs of the victim. So we are satisfied with that outcome.”
The charges stemmed from Guerrero improperly recording an underage family member in the shower. The victim noticed the cell phone camera after it appeared underneath the door. She then notified two family members about the incident. The second set of family members reported the incident to the Waxahachie Police Department. Officers arrested Guerrero April 16, 2017.
Wilson stated when police arrived on scene Guerrero was packing his belongings to leave the residence.
“He did admit that he did use the cell phone to look under the door. He gave police consent to look on his phone. He claimed that he had nothing incriminating on it,” Wilson said. “Police found in a ‘deleted photos’ folder various images of the victim nude on multiple occasions.”
Officers were later notified of a second victim, who is now an adult. The second victim told police that Guerrero sexually molested her when she was a child.
An Ellis County Grand Jury indicted Guerrero June 14, 2017.
Wilson added Guerrero would have to serve half of his sentence before he is eligible for parole. The Texas Department of Criminal Justice website states Guerrero’s parole eligibility date is April 16, 2021. His projected release date is April 16, 2025.
Guerrero was transferred from the Wayne McCollum Detention Center in Waxahachie March 21. He currently is housed at the Reverend C.A. Holliday Transfer Facility in Walker County, which has an inmate population of 2,128. Once released from prison, Guerrero will have to register as a sex offender.
